§ 1 Scope
(1) These General Terms and Conditions (AGB) apply to all contracts between IBRA Transport, owner Chirin Abdullah, Breite Str. 3, 40213 Düsseldorf (hereinafter "Contractor") and the client (hereinafter "Customer") for moves, transports and related services.
(2) Deviating terms of the Customer are not recognised unless the Contractor expressly agrees to their validity in writing.
(3) These terms also apply to all future business with the Customer, insofar as it concerns transactions of a related nature.
§ 2 Offer and conclusion of contract
(1) The Contractor's offers are subject to change and non-binding unless they are expressly marked as binding.
(2) A contract is only concluded by the Contractor's written order confirmation or by the actual performance of the service.
(3) Cost estimates and surveys are free of charge and non-binding unless expressly agreed otherwise.
(4) Fixed-price offers are binding and apply to the scope of services described in the offer. Additional services beyond the agreed scope are charged separately.
§ 3 Scope of services
(1) The scope of the services to be provided is set out in the written offer or the order confirmation.
(2) The Contractor is entitled to engage subcontractors to carry out parts of the services.
(3) Changes to the scope of services require the written agreement of both parties.
§ 4 Customer obligations
(1) The Customer must ensure that the Contractor can properly perform the agreed services. This includes in particular:
- clearing access routes in good time,
- providing parking spaces or temporary no-parking zones (Halteverbotszonen),
- packing the household goods completely and in good time, unless a packing service has been booked,
- labelling fragile or particularly valuable items,
- handing over all necessary keys.
(2) Valuables, documents, jewellery and cash must be transported by the Customer personally unless expressly agreed otherwise.
(3) Dangerous goods and items prohibited by law are excluded from transport.
§ 5 Prices and payment
(1) The prices stated in the offer or order confirmation apply. All prices include statutory VAT.
(2) Unless agreed otherwise, payment is due on completion of the service (in cash or by bank transfer).
(3) For long-distance moves or orders involving considerable material costs, the Contractor may request a reasonable deposit.
(4) If the Customer defaults on payment, the Contractor is entitled to charge default interest at the statutory rate.
§ 6 Cancellation and withdrawal
(1) The Customer may cancel the order at any time before the service begins. Cancellation must be made in writing.
(2) The following cancellation fees apply:
- Up to 14 days before the moving date: free of charge
- 7–13 days before the moving date: 30% of the agreed price
- 3–6 days before the moving date: 50% of the agreed price
- Less than 3 days before the moving date: 80% of the agreed price
(3) The Customer is free to prove that the Contractor has suffered no loss or a lower loss.
§ 7 Liability and insurance
(1) The Contractor is liable for damage to the household goods in accordance with the statutory provisions, in particular §§ 451 et seq. of the German Commercial Code (HGB, removals law).
(2) In the event of loss or damage, the Contractor's liability is limited to €620 per cubic metre of loading space, unless higher insurance cover has been agreed.
(3) Damage must be reported to the Contractor in writing without delay, and no later than the day after delivery. Damage that is not externally visible must be reported within 14 days of delivery.
(4) The Contractor is not liable for damage caused by inadequate packing by the Customer, by force majeure or by the natural condition of the goods.
(5) Any further liability for damages – regardless of the legal grounds – is excluded unless the Contractor has acted with intent or gross negligence.
§ 8 Temporary no-parking zone
(1) If agreed, the Contractor applies for the necessary temporary no-parking zones. The costs are invoiced to the Customer separately.
(2) The Contractor does not guarantee that the no-parking zone will actually be clear at the time of the move. Additional costs caused by blocked no-parking zones (e.g. longer carrying distances) are borne by the Customer.
§ 9 Storage
(1) The separately agreed storage conditions apply to the storage of household goods.
(2) The Contractor is liable for the proper safekeeping of the stored goods. Liability is limited to the current value of the stored goods.
(3) The minimum storage period is one month. After that, the contract can be terminated monthly with 14 days' notice to the end of the month.
§ 10 Data protection
The Contractor processes the Customer's personal data exclusively in accordance with the applicable data protection regulations. Details are set out in the privacy policy on our website.
§ 11 Final provisions
(1) The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
(2) The place of jurisdiction for all disputes arising from this contract is Düsseldorf, provided the Customer is a merchant, a legal entity under public law or a special fund under public law.
(3) Should individual provisions of these terms be or become invalid, the validity of the remaining provisions shall not be affected. The parties undertake to replace the invalid provision with a valid one that comes closest to its economic purpose.
